Privacy Policy

We respect your privacy and are committed to protecting your personal information. This policy explains how we collect, use, share, retain and protect personal information under the Protection of Personal Information Act 4 of 2013 (POPIA). It applies to customers, prospective customers, business contacts and website visitors who interact with our business.

This policy covers the following businesses within Fired Up Kilns Africa:

  • Cape Pottery Supplies (Pty) Ltd — registration number 2025/848841/07
  • Kiln Contracts (Pty) Ltd — registration number 1980/006798/07
  • The Clay Man (Pty) Ltd — registration number 2025/848868/07, including its divisions
    • Claybright
    • Oudekaap Bisque

In this policy, “we”, “us” and “our” refer to the relevant legal entity handling your information. The entity identified on your quotation, order, invoice or other communication is ordinarily the responsible party for that interaction. Claybright and Oudekaap Bisque are divisions of The Clay Man (Pty) Ltd, which is the relevant legal entity for their activities. Where another entity determines how and why your information is processed, we will identify it in the relevant notice. You may contact us to clarify which entity handles your information.

Personal information includes information about identifiable living individuals and, where applicable, identifiable existing companies and other juristic persons.

Information we collect

Depending on your dealings with us, we may collect your name, business name, email address, telephone number, delivery and billing addresses, order and payment information, and correspondence or information supplied when you contact us. For repairs, maintenance or warranty enquiries, we may also collect product details and service records linked to you.

We may collect IP addresses, device and browser details, cookie identifiers and website usage information. These can be personal information where they identify you or can be linked to you; they are not necessarily anonymous.

How we collect information

We generally collect information directly from you when you request a quotation, place an order, contact us or use our website. We may also receive relevant information from someone authorised to act for you, payment providers, couriers or manufacturers assisting with an order or service request. Where required, we will tell you about another source when collecting your information.

Providing information is generally voluntary. However, we need certain contact, delivery and transaction details to respond to enquiries, fulfil orders and meet legal obligations. Without those details, we may be unable to provide the requested product or service. Where information is required by a particular law, we will identify that requirement at collection. Marketing consent is optional.

How and why we use information

We use relevant personal information to prepare quotations, process payments and orders, arrange delivery, provide customer support, handle repairs and warranties, communicate about your purchases, improve our website and services, protect our systems, resolve disputes and meet legal and regulatory obligations.

We process information only where POPIA permits it. Depending on the purpose, this may be necessary to conclude or perform a contract with you, comply with a legal obligation, protect your legitimate interests, pursue our or a third party’s legitimate interests, or act with your consent. Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect processing that was lawful before withdrawal. Any further use must be compatible with the original purpose or otherwise permitted by law.

Payment information

Electronic payments are processed through third-party payment providers. We retain order, invoice and transaction records where necessary for accounting, customer service and legal purposes. We do not retain full payment-card details or card security codes. If payment information is temporarily recorded to complete a transaction, we restrict access and securely destroy it as soon as it is no longer required. Please do not send full card details by email or other unsecured channels.

Sharing information

We may share relevant information with couriers, shipping carriers, freight forwarders, customs authorities, payment providers, website and IT service providers, professional advisers, and manufacturers assisting with repairs, maintenance or warranties. We may also disclose information to authorities where legally required or otherwise lawfully justified. We share only information needed for the relevant purpose. We do not sell or rent personal information.

Where necessary for your enquiry, order or support request, relevant information may be shared between the businesses listed above on a lawful basis. Each recipient’s role and responsibilities depend on the processing involved. Group membership alone does not authorise unrestricted sharing or marketing by another entity.

Where a service provider processes information on our behalf as an operator, we require a written agreement covering confidentiality and appropriate security safeguards under POPIA. Some recipients, such as payment providers or authorities, may process information independently under their own legal obligations and privacy notices.

International transfers

Our technology, payment, shipping or manufacturer arrangements may require information to be processed outside South Africa, including in Australia where relevant to your order or service. Before a transfer, we will ensure that a lawful basis under section 72 of POPIA applies. This may include a recipient being bound by a law, binding corporate rules or an agreement providing adequate protection, including restrictions on onward transfers; your consent; or a transfer necessary to perform our contract with you.

Where applicable, we will provide further notice of the destination and protection afforded to your information. You may contact our Information Officer for details of relevant overseas recipients and safeguards. Placing an order does not by itself constitute blanket consent to overseas processing.

Cookies and website links

Our website may use cookies and similar technologies to support functionality, understand traffic and improve the browsing experience. Where these involve personal information, we process it on a lawful basis and obtain consent where required. You can control cookies through your browser, although disabling some cookies may affect website functionality.

Our website may link to third-party websites. Their operators are responsible for their own privacy practices. Please review their privacy notices before providing personal information.

Marketing communications

We send electronic direct marketing, including email, SMS or WhatsApp marketing, only with your consent or where POPIA’s existing-customer exception applies. That exception is limited to our own similar products or services, using contact details obtained during a sale, where you were offered a free and straightforward opportunity to object when the details were collected and in each marketing communication.

You can object to direct marketing at any time by using the unsubscribe facility or contacting us. Each electronic marketing message identifies the sender and provides a way to stop further marketing. We honour opt-outs and may retain limited details to ensure your preference is respected. Necessary order or service communications may still be sent.

Retention and security

We keep personal information only for as long as necessary for the purpose for which it was collected, unless further retention is required or permitted by law, reasonably needed for lawful business purposes, required by contract, or supported by valid consent. Relevant considerations include tax and accounting requirements, warranty periods and disputes. We securely destroy, delete or de-identify records when retention is no longer justified, and restrict processing where POPIA requires it.

We use reasonable technical and organisational safeguards to protect against loss, damage, unauthorised destruction, unlawful access and unlawful processing. We assess risks and review safeguards, including access controls and confidentiality arrangements. No transmission or storage system is completely secure.

If there are reasonable grounds to believe that an unauthorised person has accessed or acquired personal information, we will notify the Information Regulator and affected data subjects as soon as reasonably possible after discovery, as required by section 22 of POPIA, subject to its permitted exceptions and delays.

Your privacy rights

Subject to POPIA and applicable access-to-information rules, you may ask whether we hold personal information about you and request access; request correction or deletion of information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained; and request deletion or destruction of records we are no longer authorised to retain.

You may also withdraw consent, object on reasonable grounds to processing based on relevant legitimate interests, object to direct marketing at any time, and exercise applicable rights relating to decisions based solely on automated profiling that have legal or substantial effects. Deletion and objection rights are subject to the conditions and exceptions in law.

Send requests to our Information Officer using the details below. We may require reasonable proof of identity and authority to protect your information. We will explain applicable procedures, any lawful fee and any lawful reason for refusing a request. Confirmation of whether we hold your personal information is free. Our PAIA Manual, where applicable, is available at [PAIA Manual link or access location] and explains access procedures under the Promotion of Access to Information Act 2 of 2000.
